Injuries and the Elderly in Virginia

As a Virginia personal injury attorney, I often represent folks who are older.  As we baby boomers age, we are now in our 60's and 70's and so that doesn't seem so old anymore.  People are also living well into their 80's and even 90's in good health and with a degree of independence and happiness that prior generations could only dream of.

Elderly people suffer more serious injuries

As the U.S. population ages, there will be more and more senior citizens and older retired folks.  Some of the issues that arise in personal injury cases with an older client include the following:

  1. Injuries are often more severe to an older person because our bones are more susceptible to being broken as we get older.  It's also harder to heal up when you are of a certain age than it would have been when you were decades younger.
  1. Medicare is an issue in patients who are on this benefit which includes folks who are disabled or over 65.  The main thing to know is that Medicare has to be paid back for the bills they paid that were related to the accident if you make a recovery.
  1. Issues of caregiving are often trickier when a severe injury occurs to an older person because they are perhaps more likely to be living alone or have less of a network around them of folks to help out through the recovery period.  It's wonderful if there are adult children for a living healthy spouse, as well as potentially church or neighborhood friends.  Often, however, a major expense can be providing assistance with acts of daily living as well as more advanced medical needs when an older person gets hurt in an accident.
